Terms of Service — Swyftreach

1. Acceptance of Terms

By accessing or using Swyftreach ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

Swyftreach provides a cloud-based cold email automation platform that enables businesses to manage email campaigns, warm up email accounts, track analytics, and manage contacts. The service is provided on a subscription basis with multiple pricing tiers.

3. Account Registration

You must create an account to use the Platform. You agree to:

Provide accurate, current, and complete registration information
Maintain the security of your account credentials
Promptly notify us of any unauthorized use of your account
Be responsible for all activities that occur under your account

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.

4. Acceptable Use Policy

You agree to use the Platform only for lawful purposes. You must not:

Send unsolicited bulk email (spam) in violation of CAN-SPAM, GDPR, CASL, or other applicable laws
Use the Platform to send emails to recipients who have not opted in or who have previously unsubscribed
Transmit malicious code, viruses, or any content that could harm systems or users
Attempt to gain unauthorized access to any part of the Platform or its infrastructure
Use the Platform for phishing, fraud, or any deceptive practices
Resell or sublicense the Platform without written permission from Swyftreach
Violate any applicable laws, regulations, or third-party rights

5. Subscription and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable fees. All fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change pricing with 30 days' written notice. Contact add-ons are charged separately and are non-refundable once consumed.

6. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms. You are responsible for ensuring you have the right to upload and process any contact data you import into the Platform, and that doing so complies with all applicable privacy laws.

7. Intellectual Property

The Platform, including its design, code, content, and trademarks, is owned by Swyftreach and protected by intellectual property laws. You retain ownership of the content you create and upload. By using the Platform, you grant Swyftreach a limited, non-exclusive license to process your content solely for the purpose of providing the service.

8. Limitation of Liability

To the maximum extent permitted by law, Swyftreach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance. We reserve the right to modify or discontinue features with reasonable notice. We are not liable for downtime caused by third-party providers or events outside our control.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if we determine you have violated these Terms. Upon termination, your access to the Platform will cease and your data will be deleted after a 30-day grace period unless required to be retained by law.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Platform. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
